as in said appeal are hereunto annexed and said town clerk having selected us the undersigned three of the supervisors of said county for the hearing of said appeal and we having met on the 23rd day of November A.D. 1865 at 11 o’clock a.m. at the house of John Hatch and by agreement of parties we adjourned to Gilberts Hall in the Village of DeKalb to hear the proofs and allegations of the parties being the time and place agreed upon by us, when and where we would meeting to consider such appeal and it appearing that said commissioners of highways and three of the petitioners in said case had been duly notified of such meeting as required by law we did proceed to have the proofs and allegations of the parties and to consider said appeal.

And we being now fully advised in the promises are of opinion that the discontinuance of said highway is necessary and proper and hat the public interest will be promoted thereby. 

We do therefore order that the order and determination of said commissioners of highways be and the same is hereby reversed.

 

And do order and determine that said highway be and the same is discontinued according to the petition therefor.

 

In witness whereof we have hereunto set our hand this 23rd day of November A.D. 1865.

Fees of Supervisors one day each  $4.50
