Town of DeKalb, County of DeKalb, State of Illinois

I, E. A. Porter, town clerk of the town of DeKalb do hereby certify that on the 7th day of December that on the 7th day of December A.D. 1867 came Calvin s. Colton and filed with me his appeal in writing, appealing from the commissioners of highways of said town of DeKalb in refusing to assess sufficient damages in altering or relocating a highway through the farm of the said C. S. Colton, commencing at a point in the eaten tract of the travelled road running from Phineas Stevens to and westerly y Calvin S. Colton, the point is near said Colton’s house where the two roads intersect, thence northerly towards Jesse Alden’s house to a point or angle in said Brush Point Road at or near Jesse Alden’s house.

Which order of said commissioners in refusing to assess sufficient damages was deposited with me and files the 7th day of December A.D. 1867.  The grounds on which said appeal is made are 1st said new road so laid out is entirely unnecessary and uncalled for by the public. 2nd the benefit to the public if any is entirely disproportionate to the damages to your petitioner and therefore ought not to have been altered or relocated.  3rd the damages assessed to your petitioner are altogether too low and disproportionate to the damages sustained by him in the laying out or relocating said road and that I have selected Lewis McKerwin Supervisor of the town of Milan; John Wright Supervisor of the town of Pampas; Henry A. Perkins Supervisor of the town of Genoa

To hear and determine said appeal and have had in making such selections due regard to the interests of the persons interested.  Given under my hand this 26th day of December A.D. 1867
