to the owners of the lands over which said proposed route for a road passes would be oppressive and a sacrifice by them that the public does not demand and said appeal is brought in relation to discontinuing said highway and to reverse entirely the determination of said commissioners. The undersigned therefore ask you as Town Clerk of said town will proceed according to law and select three supervisors to hear and determine said appeal.

I, E. A. Porter of said town of DeKalb do hereby certify that one the 25th day of October A.D. 1865 came John Hatch and C. M. Simmons and filed with me their appeal in writing appealing from the Commissioners of highways of said town of DeKalb in refusing to discontinue a highway in said town as follows, commencing at a point on a section line between section twenty & twenty one in township 40.N.R.E. of 3rd P.M. there the St. Charles and Oregon road crosses said line, thence south on said line to the south line of said section. Thence west on the section line between section twenty & twenty nine to the centre of section twenty & twenty nine of the line of Government survey to the south line of said township 40.N.R.4E of 3rd P.M. (or so much thereof as has not been herein fore discontinued) which order of said commissioners in refusing to discontinue said road was deposited with me and filed on the 7th day of October A.D. 1865. The grounds on which said appeal is made are that the road in question is not required by the public for public
