Road Appeal

Whereas Peter J. Rickard of the Town of South Grove in said Co. did on this 22nd day of July 1858. appeal to us from an order of determination of the Commissioners of highways of said town contained in the order of said Commissioners deposited with the town Clerk of said town and filed the 8th day of July 1858 a copy of which said orders as well as all the papers before us in said appeal are hereunto annexed. And we having met on the 27th day of Sept. 1858 at 10 o lock [o’clock] A. M. at the House of P J. Rickard in said town to hear the proof & allegations of the parties being the time & place agreed upon by us when and where we would meet and consider said appeal & Horace S. Champlin being unable to attend we associated with the other two Supervisors C. T Wetmore of Etna & its appearing that said commissioner of highways & them of the petitioners in said case had been duly notified of such meeting as is required by law. We did proceed to hear the proof & allegation of the parties & to consider said appeal & we being now fully advised in the premises do adjudge, order & determine that the decision of said Commissioners as to laying said road be confirmed, & we also adjudge that the said Peter J. Rickard is entitled to ninty [ninety] dollars ($90) damages & we hereby assess & award to the sum of $90 as aforesaid.. In witness whereof we hereunto set our hands this 27th day Sept 1858[.]
