Whereas a road having been laid out on the 27th day of Nov 1867 by E. B .Hulett, Jesse Alden and Lucian Burr Commissioners of Highways in the town of DeKalb in the county of DeKalb o the application of the requisite number of legal voters residing within three miles of said road as follows. Commencing in an angle on the road known as the Brush Point road near Jesse Alden’s running in a southerly direction and intersecting the road near the school house in District No. one that passes by William Hubbard’s which road passes through certain lands owned by me (being known as follows, lands which I purchased of H. H. Rowe being known as the Rufus Colton farm) Now therefore known all men by these present that I, Spafford Smith for value received do hereby release all claims to damages sustained by me by reason of laying out and opening said road through my said lands as above described.

Whereas upon application of I. L. Ellwood, Hiram Ellwood, J. S. Reynolds and others twelve legal voters residing within three (3) miles of a road hereinafter described for a public highway, a copy of their petition having been duly posted as required by law, we the said Commissioners of said town did on the 4th day of December 1867 cause a survey to be made by the county surveyor as follows to wit, on section two (2) town forty (40) N R 4E 3rd PM commencing at or near the house of Wm. Hubbard
