J. B. Colton being duly sworn doth dispose and say that he did on the 31st day of December A.D. 1867 make service of a notice in writing of which the within is a true copy upon J. H. Almy, A Schryver and J. F. Walker being three of the petitioners who petitioned for the altering or relocating of the said road hereinafter described by delivering one to each of said petitioners.

Whereas on the twenty sixth day of December A.D. 1867 Calvin S. Colton filed with the town clerk of the town of DeKalb in the county of DeKalb an appeal addressed to said town clerk appealing from the order and determination of the commissioner of highways of said town of DeKalb in altering or relocating a highway as contained in the order of said commissioner, deposed with said town clerk and filed in his office on the seventh day of December A.D. 1867 a copy of which said order as well as all the papers before us in said appeal as hereunto annexed and said town clerk having selected us the undersigned three supervisors of said county for the hearing of said appeal and we having met on the twentieth day of January A.D. 1868 at ten o’clock A.M. at the house of C. S. Colton and adjourned until the 27th day of said month and having met on the 27thday of January as per adjournment to hear the proof and allegation of the parties being the time and place agreed upon by us where and whereas we would meet to consider such appeal and it appearing that said commissioners of highways and three of the petitioners in said case had been duly notified of such meeting as required by law did proceed to hear the proofs and allegations of the parties and to consider said appeal and we being more fully advised in the premises do adjudge order and determine that the order and determination of said commissioners of highway be and the same is in all things reversed.
