We the undersigned commissioners of highway met on the written petition on the eleventh day of August & adjourned to the (20) twentieth of August.

We the undersigned commissioners of Highway after viewing the written described road have not granted the petition.

Where as Calvin S. Colton of the town of DeKalb in said county did on the twenty second day of August eighteen hundred and fifty six appeal to us from and order and determination of the commissioners of highways in said town in laying out the following highway to wit so much of the road leading from Brushty (Brush) Point to DeKalb Centre as lies between a point in the centre of said road whereas it formerly turned easterly near Abial Richardson barn and a point in the center road of near the house of Wm. Hubbard it being the road recently located by supervisors Terry, Whitehead and Noble and to be located the same as it was formerly a ?? of which orders as well as all the papers in relation to said appeal being hereunto annexed and passing a part of this order.

And we having met at the house of Calvin S. Colton in said town on the first day of October to hear the ?? and
