Road Appeal

Whereas JohnMcKensie [McKenzie] of the town of South Grove of said Co. did on the 22 – day of July 1858 appeal from an order & determination of the Commissioners of highway of said town contained in the order of said Commissioners deposited within the Town Clerk of said town & filed on the 8th day of July 1858 a copy of which as was as all the papers before us in said appeal hereunto annexed & we having met on the 27th day of Sept 1858 at 10 o.clock [o’clock] in the forenoon at the room of P. J Ricker in said town to hear the proofs and allegations of said parties being the time & place again upon us when & where we would meet to consider said appeals & Horace L. Champlain being unable to attend as associated with the other two supervisors, T. C. Wetmore Sup. ofEtna& it appears that said petitioners of Highways & them of the petioners [petitioners]in said case had been duly notified of such meeting as required by law [.] We did proceed to hear the proofs & allegations of parties & to consider said appeal. & we being now fully advised in the premises do adjudge, order, & determine that the decision of said Commissioners as to laying said road be confirmed; and we do adjudge that the said John McKensie [McKenzie] is entitled to forty dollars damages & we do hereby assess & award the sum of forty dollars for his damages as aforesaid.
